Exculpatory Clauses in Construction Contracts, Calgary, Canada

The Society of Construction Law – Prairies Chapter warmly invites you to an in-person panel discussion titled ‘Exculpatory Clauses in Construction Contracts’. Contract clauses that purport to limit or exclude one party’s liability for certain types of losses or events are common in construction contracts. However, if a party does not understand the risks they are taking in signing contracts that significantly curtail their normal rights, the consequences can be catastrophic. Contractors may seek to find ways to circumvent these clauses, while owners may insist on strict enforcement. Are there instances where these clauses may become unenforceable, or less onerous, due to the actions of either party? This panel discussion will explore the types of clauses all parties to construction projects should be aware of, and how to adequately assess the risks they present. The panel will include input on best practices for owners, consultants, contractors and subcontractors, from experienced in-house and private practice counsel. This presentation is a “must attend” event for all construction industry participants. This presentation will commence on September 21, 2022, at 4.00PM MST. A drinks reception with canapes will be between 5.30PM and 7.00PM
