Strategic Use of Experts in Construction Arbitration

Construction arbitration often turns on expert evidence, but even highly qualified experts can be used ineffectively. During this webinar, an experienced construction lawyer, construction expert witness, and construction arbitrator will explore how counsel can select, prepare, present, and challenge experts more strategically. The panel will discuss defining the expert’s assignment, developing credible opinions, coordinating multiple disciplines, preparing persuasive reports and demonstratives, handling assumptions and incomplete project records, presenting damages and delay analyses clearly and persuasively, preparing for cross-examination, and using expert conferencing or “hot-tubbing.” The speakers will also identify common mistakes that undermine an expert’s credibility—and explain what arbitrators find most helpful when evaluating competing expert opinions.
