In complex and high-stakes construction and infrastructure projects, defects are one of the “triangle” of typical construction claims that practitioners come across. International construction disputes often have a “defects” element and young arbitration practitioners will need to consider issues such as the standard of care, contractual provision for remediation of defects and the role of experts in assisting with defect claims.
